اطلاعیه شماره ۴۳ قوه قضاییه در مورد جنگ تحمیلی سوم؛
ستاد حقوق بشر: حملههای عامدانه به داراییها و معیشت مردم جنایت جنگی است
ستاد حقوق بشر جمهوری اسلامی ایران با انتشار بیانیهای حملههای عامدانه رژیم صهیونیستی و آمریکا به داراییها و معیشت مردم، ازجمله لنجهای صیادی و ایجاد حریق در شناورهای مردمی را محکوم کرد.
حقوق بشر جمهوری اسلامی ایران ضمن محکوم کردن حملههای عامدانه رژیم صهیونیستی و آمریکا به داراییها و معیشت مردم، ازجمله لنجهای صیادی و ایجاد حریق در شناورهای مردمی، تاکید کرد که این اقدامهای تجاوزکارانه، افزون بر آن که مصداق نقض آشکار حقوق بنیادین بشر و حقوق بشردوستانه به شمار میروند، ممکن است به عنوان جنایت جنگی مورد شناسایی قرار گیرد.
متن این بیانیه به شرح زیر است:
ستاد حقوق بشر جمهوری اسلامی ایران، حملات مکرر و عامدانه رژیم صهیونیستی و آمریکا علیه مجموعهای گسترده از اهداف غیرنظامی، ازجمله منازل مسکونی، بیمارستانها، مراکز درمانی و امدادی، زیرساختهای حیاتی، مراکز اقتصادی، پلها، مدارس و همچنین شناورها و لنجهای مورد استفاده برای معیشت مردم، از جمله حمله به ۴ فروند لنج صیادی در بندر لنگه و ایجاد حریق در سایر شناورهای مردمی و ... را با قاطعیت محکوم میکند.
این اقدامات تجاوزکارانه، افزون بر آن که مصداق نقض آشکار حقوق بنیادین بشر و حقوق بشردوستانه به شمار میروند، ممکن است به عنوان جنایت جنگی مورد شناسایی قرار گیرد.
هدف قرار دادن عمدی اماکنی که ارتباط مستقیم با زندگی روزمره و معیشت مردم دارند، ازجمله لنجهای صیادی که تامینکننده معاش شمار بسیاری از خانوادههای ساحلنشین میباشد، نقض صریح ابتداییترین اصول انسانی و حقوقی است؛ در نتیجه این حملات، حقوق بنیادین بشر، ازجمله حق حیات، حق کار و حق توسعه بهطور مستقیم مورد تعرض قرار گرفتهاند.
این جنایات در حالی رخ میدهد که مقامات رسمی آمریکا، ازجمله رئیسجمهور متوهم و مستبد این کشور و وزیر جنگ جنایتکار آن، در اظهاراتی صریح، تهدید به بازگرداندن ایران به «عصر حجر»!! و حمله به «پلها، زیرساختهای حیاتی، انرژی و برق» کردهاند؛ این اظهارات، نهتنها اعترافی آشکار به قصد مجرمانه، بلکه سندی روشن بر نیت جنایت جنگی این رژیم متجاوز، تلقی میگردد.
مطابق اصل بنیادین تفکیک (اصل تمایز میان نظامی و غیرنظامی) در حقوق بینالملل بشردوستانه، تمامی اطراف مخاصمه موظفاند از هدف قرار دادن افراد و اموال غیرنظامی اجتناب ورزند؛ حملات نظاممند علیه مردم عادی، شریانهای حیاتی کشور و زیرساختهای توسعهای، نقض فاحش این اصول و مصداق جنایت جنگی است.
استراتژی عملی «مجازات جمعی» ایرانیان که از سوی رژیم صهیونیستی و آمریکا دنبال میشود، در تعارض آشکار با اصل ممنوعیت تهدید و توسل به زور در حقوق بینالملل قرار دارد؛ این رویکرد ضد انسانی، که از منطق قانون، اخلاق و وجدان بشری تهی است، ذهنیت واقعی آمران و مجریان این حملات وحشیانه را آشکار میسازد.
ستاد حقوق بشر جمهوری اسلامی ایران، ضمن تاکید بر مسئولیت مستقیم رژیم صهیونیستی و آمریکا در قبال این جنایات، خواستار واکنش فوری و قاطع جامعه جهانی، نهادهای حقوق بشری و سازمان ملل متحد است.
این نهادها موظفاند:
۱. این حملات را بهعنوان جنایت جنگی و نقض جدی منشور ملل متحد شناسایی نمایند.
۲. با تقبیح چنین اعمالی، از تداوم حملات علیه مردم، محیطزیست و زیرساختهای اقتصادی و انرژی و اماکن و اموال غیرنظامی و مرتبط با معیشت جمعیت غیرنظامی جلوگیری به عمل آورند.
ستاد حقوق بشر مجددا تاکید مینماید که هرگونه سکوت یا بیتفاوتی از سوی نهادهای بینالمللی، تایید و همراهی در این جنایات است؛ جمهوری اسلامی ایران، در راستای پایبندی به اصول منشور ملل متحد و در عمل به حق دفاع مشروع خویش، تمامیّت ارضی و امنیت ملی خود را محفوظ میدارد و به دفاع مشروع خود مطابق ماده ۵۱ منشور ملل متحد ادامه می دهد و از تمامی دولتها، نهادهای بینالمللی و مراجع حقوق بشری میخواهد تا وظایف قانونی خود را در مقابله با متجاوزان و پاسخگو نمودن آنها ایفا نمایند.

Statement by the High Council for Human Rights of the Islamic Republic of Iran, Condemning the Deliberate Attacks by the Zionist Regime and the United States against the Assets and Livelihood of the People, Including Fishing Boats and the Setting Fire to Civilian Vessels
The High Council for Human Rights of the Islamic Republic of Iran unequivocally condemns the repeated and deliberate attacks by the Zionist regime and the United States against a wide range of civilian objects, including residential homes, hospitals, medical and relief centers, critical infrastructure, economic facilities, bridges, schools, as well as vessels and boats used for the livelihood of the people, including the attack on four fishing boats in Bandar Lengeh and the setting fire on other civilian vessels, among other acts.
These aggressive actions not only constitute a manifest violation of fundamental human rights and international humanitarian law but may also be recognized as war crimes.
Intentional strikes against places that serve the everyday needs and economic survival of the civilian population, notably the fishing boats that sustain countless coastal households, constitute a manifest breach of the most basic humanitarian and legal principles. As a direct consequence, these actions adversely affect the enjoyment of basic human rights, in particular the right to life, the right to work, and the right to development.
These crimes occur against a backdrop of explicit threats made by high-level United States officials, including the delusional and tyrannical President and his criminal Secretary of War, who have publicly declared their intention to back Iran to the "Stone Age" and to strike "bridges, critical infrastructure, energy and electricity." Such statements amount not merely to an acknowledgment of hostile intent but also to clear evidentiary support for the finding of an intention to commit war crimes by this aggressor regime.
Under the cardinal principle of distinction (the distinction between military and civilian objects), as enshrined in international humanitarian law, all parties to an armed conflict are obligated to avoid targeting civilian persons and civilian objects. The deliberate and systematic nature of attacks directed at ordinary civilians, the country's lifelines, and its developmental infrastructure represents a serious violation of these obligations and qualifies as a war crime.
The deliberate policy of "collective punishment" directed against the Iranian people, as pursued by the Zionist regime and the United States, is in clear violation of the prohibition of the threat or use of force enshrined in international law. Such a practice, which lacks any foundation in legal logic, moral standards, or human conscience, reveals the underlying intentions of the perpetrators and executors of these brutal acts.
The High Council for Human Rights of the Islamic Republic of Iran, underscoring the direct accountability of the Zionist regime and the United States for these criminal acts, demands an urgent and decisive reaction from the international community, relevant human rights mechanisms, and the United Nations.
These institutions are duty-bound to:
1. Classify these attacks as war crimes and as serious breaches of the Charter of the United Nations;
2. Denounce such actions and take measures to halt further attacks against the people, the environment, economic and energy infrastructure, and civilian assets and property that serve the basic sustenance of the civilian population.
The High Council for Human Rights of the Islamic Republic of Iran further affirms that any silence or inaction by international bodies would be tantamount to approval of, and complicity in, these crimes. The Islamic Republic of Iran, adhering to the principles of the United Nations Charter and acting in the exercise of its inherent right to self-defence, upholds its territorial integrity and national security. It shall continue to exercise that right under Article 51 of the UN Charter, and urges all States, international institutions, and human rights mechanisms to discharge their legal duties to counter the aggressors and ensure their accountability.
