بیانیه ستاد حقوق بشر جمهوری اسلامی ایران در محکومیت حمله متجاوزانه به مکان مذهبی و غیرنظامی

ستاد حقوق بشر با انتشار بیانیه‌ای حمله هوایی به ساختمان اداری حسینیه اعظم زنجان را که منجر به شهادت و مجروحیت جمعی از شهروندان بی‌گناه شد، به‌شدت محکوم کرد.

متن این بیانیه به شرح زیر است:

ستاد حقوق بشر جمهوری اسلامی ایران حمله هوایی به ساختمان اداری حسینیه اعظم زنجان را که منجر به شهادت و مجروحیت جمعی از شهروندان بی‌گناه گردید به‌شدت محکوم می‌نماید و این اقدام را نقضی فاحش و غیرقابل توجیه از اصول بنیادین حقوق بین‌الملل، به‌ویژه حقوق بشردوستانه بین‌المللی و حقوق بشر می‌داند.

حسینیه اعظم زنجان به‌عنوان یک مکان مذهبی، فرهنگی و اجتماعی، ازجمله اماکن غیرنظامی محسوب می‌شود که مطابق قواعد مسلم حقوق بین‌الملل، از حمایت ویژه برخوردار است؛ حمله به چنین اماکنی که محل تجمع شهروندان و فعالیت‌های مذهبی و انسانی است، نقض آشکار اصل تفکیک میان اهداف نظامی و غیرنظامی و ممنوعیت حمله به اشخاص و اموال غیرنظامی به‌شمار می‌رود.

این اقدام که منجر به جان‌باختن و مجروحیت شهروندان غیرنظامی شده است، نقض صریح حقوق بنیادین بشر ازجمله حق حیات، حق امنیت شخصی و حق آزادی دین و انجام مناسک مذهبی محسوب می‌گردد؛ همچنین براساس قواعد حقوق بشردوستانه بین‌المللی و اسناد مرتبط، حمله به اماکن مذهبی و فرهنگی، به‌ویژه در شرایطی که هیچ‌گونه کاربری نظامی ندارند، می‌تواند در زمره نقض‌های جدی و در مواردی مصداق جنایت جنگی تلقی شود.

ستاد حقوق بشر جمهوری اسلامی ایران ضمن ابراز همدردی با خانواده‌های قربانیان این حادثه، از تمامی نهادهای بین‌المللی، به‌ویژه شورای حقوق بشر سازمان ملل متحد و سایر مراجع ذی‌صلاح، می‌خواهد با درک ابعاد این اقدام غیرانسانی، نسبت به محکومیت صریح آن و اتخاذ تدابیر لازم برای جلوگیری از تکرار چنین حملاتی اقدام نمایند.

بدیهی است تداوم این‌گونه اقدامات و سکوت در برابر آن، موجب تضعیف هنجارهای بنیادین حقوق بین‌الملل و افزایش تهدیدات علیه صلح و امنیت انسانی خواهد شد.
ستاد حقوق بشر جمهوری اسلامی ایران تاکید می‌نماید که پیگیری حقوقی این اقدام و پاسخگو کردن عاملان آن از طریق سازوکارهای بین‌المللی ذی‌صلاح، حق مسلم جمهوری اسلامی ایران بوده و در دستور کار قرار دارد.

Statement of the High Council for Human Rights of the Islamic Republic of Iran Condemning the Aggressive Attack on a Religious and Civilian Site

In the Name of God, the Most Compassionate, the Most Merciful

The High Council for Human Rights of the Islamic Republic of Iran strongly condemns the aerial attack on the administrative building of Hosseinieh Azam Zanjan Complex, which resulted in the martyrdom and injury of a number of innocent civilians. It considers this act to constitute a grave and unjustifiable violation of the fundamental principles of international law, in particular international humanitarian law and international human rights law.

Hosseinieh Azam Zanjan Complex, as a religious, cultural, and social site, is regarded as a civilian object that, under well-established rules of international law, enjoys special protection. Attacks against such locations, which serve as venues for the gathering of civilians and for religious and humanitarian activities, constitute a clear violation of the principle of distinction between military and civilian objectives, as well as the prohibition against attacks directed at civilians and civilian property.

This attack, which has led to the loss of life and injury among civilians, constitutes a manifest violation of fundamental human rights, including the right to life, the right to personal security, and the right to freedom of religion and the performance of religious rites. Furthermore, under the rules of international humanitarian law and relevant legal instruments, attacks against religious and cultural sites, particularly when they serve no military purpose, may amount to serious violations and, in certain circumstances, may be considered war crimes.

While expressing its deepest sympathy with the families of the victims of this incident, the High Council for Human Rights of the Islamic Republic of Iran calls upon all international bodies, particularly the United Nations Human Rights Council and other competent authorities, to duly recognize the gravity of this inhumane act, to condemn it unequivocally, and to take the necessary measures to prevent the recurrence of such attacks.

It is evident that the continuation of such actions, and silence in the face thereof, will undermine the fundamental norms of international law and exacerbate threats to human peace and security.

The High Council for Human Rights of the Islamic Republic of Iran underscores that the legal pursuit of this act and the holding accountable of its perpetrators through competent international mechanisms are the inherent right of the Islamic Republic of Iran and remain firmly on its agenda.
