بیانیه ستاد حقوق بشر جمهوری اسلامی ایران در اعتراض به تخریب زیرساخت‌های اقتصادی و حیاتی

ستاد حقوق بشر در اعتراض به تخریب زیرساخت‌های اقتصادی و حیاتی و حمله‌های نظام‌مند و هدفمند رژیم صهیونیستی و آمریکا بیانیه‌ای صادر کرد.

متن این بیانیه به شرح زیر است:

ستاد حقوق بشر جمهوری اسلامی ایران به موجب این بیانیه، حمله‌های نظام‌مند و هدفمند رژیم صهیونیستی و ایالات متحده آمریکا علیه زیرساخت‌های اقتصادی و حیاتی کشور در طول یک ماه گذشته را به‌عنوان جنایتی آشکار علیه ملت ایران محکوم می‌نماید؛ این حمله‌های وحشیانه که با هدف فلج‌سازی اقتصاد ایران و ایجاد فشار حداکثری بر شهروندان غیرنظامی طراحی و در حال اجرا است، نه‌تنها مصداق بارز تروریسم اقتصادی است، بلکه نقض فاحش و غیرقابل انکار بنیادی‌ترین اصول حقوق بشر و حقوق بشردوستانه بین‌المللی محسوب می‌شود.

با توجه به حملات مکرر به کارخانه‌ها و صنایع تولیدی ازجمله مجتمع‌های عظیم فولاد، تهدید حمله به نیروگاه‌ها و دیگر تاسیسات حیاتی کشور، طبق این بیانیه تاکید می‌کند: این زیرساخت‌ها نه «اهداف نظامی» که شریان‌های حیاتی معیشت و زندگی روزمره میلیون‌ها شهروند ایرانی هستند؛ تخریب عمدی این مراکز، به صراحت اصل تفکیک (ماده ۴۸ پروتکل اول الحاقی به کنوانسیون‌های ژنو) و منع حمله به اهداف غیرنظامی (ماده ۵۲) را نقض کرده و از مصادیق بارز جنایات جنگی به شمار می‌رود.

ستاد حقوق بشر با استناد به میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی و اعلامیه جهانی حقوق بشر، تصریح می‌کند: حمله به زیرساخت‌هایی که تامین‌کننده آب، برق، سوخت، مواد غذایی و اشتغال مردم هستند، نقض مستقیم حق حیات، حق بر سلامت، حق بر کار و معیشت شایسته و حق بر توسعه است؛ هر اقدامی که بقای اقتصادی یک ملت را هدف قرار دهد، جنایتی است که نه‌تنها دولت متجاوز، بلکه همه حامیان و تامین‌کنندگان تسلیحات آن را مستوجب مسئولیت بین‌المللی می‌سازد.

در جریان این حملات تروریستی به کارخانه‌های فولاد و دیگر واحد‌های تولیدی، شماری از کارگران بی‌گناه و زحمتکش ایرانی که مشغول تامین نیاز‌های معیشتی کشور و مردم بودند، به شهادت رسیده یا مجروح شدند؛ این کارگران غیرنظامی، هیچ نقشی در منازعات نداشته و تنها قربانی سیاست‌های جنایت‌کارانه‌ای شده‌اند که با ادبیات دروغین «کمک به مردم ایران» توجیه می‌شود.

آیا کمک به مردم، تخریب محل کار آنان، به آتش کشیدن کارخانه‌هایی که نان و امید خانواده‌های ایرانی را تامین می‌کنند و به خاک و خون کشیدن کارگرانی است که برای تامین زندگی شرافتمندانه فرزندان خود تلاش نموده و می‌نمایند، صورت می‌گیرد؟!

ستاد حقوق بشر با استناد به اصول بنیادین حقوق بین الملل بشردوستانه بیان می‌دارد که تخریب نظام‌مند زیرساخت‌های حیاتی یک کشور با هدف ایجاد شرایط زندگی غیرانسانی برای جمعیت غیرنظامی و وارد آوردن صدمات اقتصادی گسترده، می‌تواند در چارچوب جنایت جنگی قابل تعقیب باشد؛ سکوت نهاد‌های بین‌المللی و کشور‌های مدعی حقوق بشر در برابر این جنایات، آنان را در زمره شرکای جرم قرار می‌دهد.

این بیانیه با محکومیت شدید این حملات وحشیانه، از تمامی سازوکار‌های بین‌المللی، از جمله شورای حقوق بشر، رویه‌های ویژه و سازمان‌های تخصصی ملل متحد می‌خواهد:

• فورا این تجاوزات را به‌عنوان نقض آشکار حقوق بشردوستانه و حقوق بشر تلقی کرده و بیانیه‌های محکومیتی صریح و بدون ابهام صادر نمایند.

• نسبت به مستندسازی جنایات علیه زیرساخت‌های اقتصادی و کارگران غیرنظامی اقدام عملی به عمل آورند.

• به جای انفعال و مماشات در برابر متجاوزان و حامیان آنان، با ایجاد سازوکار‌های پاسخگویی، جلوی تداوم این فجایع انسانی را بگیرند.

ستاد حقوق بشر جمهوری اسلامی ایران در پایان تاکید می‌کند: ملت ایران هرگز جنایت تخریب معیشت و شهادت کارگران خود را فراموش نخواهد کرد. آنانی که امروز با استاندارد‌های دوگانه، از یک سو مدعی حمایت از حقوق بشرند و از سوی دیگر شریک و تامین‌کننده ابزار این جنایات، در تاریخ حقوق بشر به‌عنوان حامیان تروریسم اقتصادی و جنایت علیه بشریت ثبت خواهند شد؛ جمهوری اسلامی ایران حق خود را برای دفاع از مردم و زیرساخت‌های کشور در چارچوب حقوق بین‌الملل محفوظ می‌داند و از هیچ تلاشی برای پاسخگویی به عاملان و آمران این جنایات فروگذار نخواهد کرد.

*The Statement of the High Council for Human Rights of the Islamic Republic of Iran Condemning the “Destruction of Economic and Vital Infrastructure: A Crime Against the Livelihood and the Right to Life of the Iranian Nation Amid the Shameful Silence of Self-Proclaimed Human Rights Advocates* 
The High Council for Human Rights of the Islamic Republic of Iran, through this statement, condemns the systematic and deliberate attacks carried out by the Zionist regime and the United States of America against the economic and vital infrastructure of the country over the past month as a manifest crime against the Iranian nation. These brutal attacks, designed and carried out with the aim of paralyzing Iran’s economy and exerting maximum pressure on civilian populations, not only constitute a clear instance of economic terrorism, but also amount to a grave and undeniable violation of the most fundamental principles of human rights and international humanitarian law.
In light of the repeated attacks against factories and industrial production facilities, including major steel complexes, as well as threats to target power plants and other critical national installations, this statement emphasizes that such infrastructure does not constitute “military objectives,” but rather represents the essential lifelines sustaining the livelihood and daily lives of millions of Iranian citizens. The intentional destruction of these facilities constitutes an explicit violation of the principle of distinction (Article 48 of the Additional Protocol I to the Geneva Conventions) and the prohibition against attacks on civilian objects (Article 52), and is therefore to be regarded as a clear instance of war crimes.

Referring to the International Covenant on Economic, Social and Cultural Rights and the Universal Declaration of Human Rights, the High Council for Human Rights of the Islamic Republic of Iran affirms that attacks on infrastructure essential for the provision of water, electricity, fuel, food, and employment constitute a direct violation of the right to life, the right to health, the right to work and to an adequate standard of living, and the right to development. Any act targeting the economic survival of a nation constitutes a crime that engages not only the international responsibility of the aggressor State, but also that of all its supporters and suppliers of weaponry.

In the course of these terrorist attacks against steel factories and other production units, a number of innocent and hardworking Iranian laborers, engaged in meeting the essential needs of the country and its people, have been killed or injured. These civilian workers played no role in any hostilities and have merely fallen victim to criminal policies that are falsely justified under the pretext of “assisting the Iranian people.” Is such “assistance” manifested through the destruction of their workplaces, the burning of factories that sustain the livelihood and hope of Iranian families, and the killing and injuring of workers striving to provide a dignified life for their children?

Appealing to the fundamental principles of international humanitarian law, the High Council for Human Rights of the Islamic Republic of Iran declares that the systematic destruction of a country’s vital infrastructure, with the aim of creating inhumane living conditions for the civilian population and inflicting widespread economic harm, may constitute war crimes under international law. The silence of international institutions and States that claim to uphold human rights in the face of such crimes, risks rendering them complicit.

Strongly condemning these brutal attacks, the statement calls upon all relevant international mechanisms and bodies, including the Human Rights Council, the special procedures, and the specialized agencies of the United Nations, to:"
* Immediately recognize these acts as clear violations of international humanitarian law and human rights, and to issue explicit and unambiguous statements of condemnation;
* Undertake practical measures to document crimes committed against economic infrastructure and civilian workers; 
* To replace inaction and appeasement towards the aggressors and their supporters with the establishment of accountability mechanisms, with a view to preventing the continuation of such humanitarian catastrophes."
In conclusion, the High Council for Human Rights of the Islamic Republic of Iran underscores that the Iranian nation will never forget the crime of destroying its livelihood and the killing of its workers. Those who today, through double standards, claim to defend human rights while simultaneously acting as partners in and suppliers of the instruments of such crimes, will be recorded in the history of human rights as supporters of economic terrorism and crimes against humanity. The Islamic Republic of Iran reserves its inherent right to defend its people and national infrastructure within the framework of international law and will spare no effort in ensuring accountability for the perpetrators and instigators of these crimes.
