ستاد حقوق بشر: نهادهای بینالمللی تحولات فرانسه را با همان معیارهای حقوق بشری در بررسی وضعیت سایر کشورها مورد توجه قرار دهند
ستاد حقوق بشر بیانیهای را در واکنش به تحولات اخیر در فرانسه و گزارشهای منتشرشده درباره نحوه مواجهه نیروهای انتظامی و امنیّتی این کشور با تجمعات و اعتراضات دانشآموزان و جوانانمنتشر کرد
متن این بیانیه به شرح زیر است:
ستاد حقوق بشر جمهوری اسلامی ایران با توجّه به تحوّلات اخیر در فرانسه و گزارشهای منتشرشده درباره نحوه مواجهه نیروهای انتظامی و امنیّتی این کشور با تجمعات و اعتراضات دانشآموزان و جوانان، بر ضرورت رعایت کامل موازین حقوق بشر و تعهدات بینالمللی دولت فرانسه تأکید میکند.
این تحوّلات در شرایطی رخ میدهد که جمهوری اسلامی ایران طی ماههای اخیر، در جریان تجاوز نظامی آمریکا و رژیم صهیونیستی به خاک کشورمان، شاهد مواضعی از سوی برخی دولتهای اروپایی، از جمله فرانسه، بوده است که از دیدگاه جمهوری اسلامی ایران با صراحت و قاطعیت مورد انتظار در قبال نقض حاکمیّت ملّی و تمامیّت ارضی یک کشور مستقل فاصله داشته است. موضعگیری درباره حقوق ملّتها و حاکمیّت قانون، زمانی از اعتبار و اثربخشی لازم برخوردار خواهد بود که این اصول در تمامی شرایط و بدون ملاحظات سیاسی و جغرافیایی به صورت یکسان مورد توجّه قرار گیرند.
در روزهای اخیر گزارشهای متعددی درباره اعتراضات دانشآموزان و جوانان در شهرهای مختلف فرانسه منتشر شده است. بر اساس این گزارشها، در جریان برخورد نیروهای پلیس با برخی تجمعات، شمار قابل توجّهی از افراد بازداشت و تعدادی از معترضان، از جمله نوجوانان، دچار جراحات شدهاند. مواردی از آسیبهای شدید جسمانی نیز گزارش شده و در خصوص برخی از این حوادث، تحقیقات رسمی از سوی مراجع ذیصلاح فرانسه، از جمله بازرسی کل پلیس این کشور در حال انجام است.
از جمله موارد گزارششده، جراحت شدید یک نوجوان ۱۴ ساله درسن-اوئن-لومون، از دست دادن بینایی یک چشم توسط نوجوانی ۱۶ ساله در تور و قطع دست یک نوجوان ۱۵ ساله در لنس در جریان حوادث مرتبط با عملیات پلیس است. با توجّه به اینکه تحقیقات درباره چگونگی وقوع برخی از این حوادث همچنان ادامهدارد، اظهارنظر نهایی درباره مسؤولیت حقوقی افراد یا نهادهای مشخص، مستلزم تکمیل تحقیقات و طی فرآیندهای قانونی است. با این حال، شدت این آسیبها ضرورت بررسی دقیق، مستقل و شفّاف این وقایع را مورد تأکید قرار میدهد.
از منظر حقوق بشر، حق آزادی تجمع مسالمتآمیز، حق آزادی بیان، منع بازداشت خودسرانه، منع رفتار ظالمانه، غیرانسانی یا تحقیرآمیز و اصل ضرورت و تناسب در استفاده از زور از جمله اصول شناختهشده حقوق بینالملل هستند. دولتها در عین مسؤولیت حفظ نظم عمومی و امنیّت شهروندان، موظّفاند در مواجهه با تجمعات و اعتراضات، میان ضرورتهای انتظامی و تضمین حقوق و آزادیهای بنیادین افراد توازن برقرار کنند.
ماده ۲۱ میثاق بینالمللی حقوق مدنی و سیاسی، حق تجمع مسالمتآمیز را به رسمیّت شناخته است. ماده ۷ همین میثاق نیز هرگونه رفتار ظالمانه، غیرانسانی یا تحقیرآمیز را ممنوع میکند و ماده ۹ بر حمایت افراد در برابر بازداشت یا حبس خودسرانه تأکید دارد. همچنین کنوانسیون حقوق کودک، که فرانسه از اعضای آن است، حمایت ویژه از کودکان و نوجوانان را مورد شناسایی قرار داده و بر رعایت مصالح عالیه کودک و رفتار متناسب با سن و وضعیّت آنان تأکید میکند.
بر اساس اصول اساسی سازمان ملل متحد درباره استفاده از زور و سلاح گرم توسط مأموران اجرای قانون نیز استفاده از زور باید تابع اصول ضرورت و تناسب باشد و تا حد امکان از روشهای غیرخشونتآمیز استفاده شود. بنابراین، حتی در شرایطی که برخی شرکتکنندگان در تجمع مرتکب رفتارهای خشونتآمیز یا اخلال در نظم عمومی میشوند، واکنش نیروهای انتظامی باید متوجّه رفتار غیرقانونی مشخص باشد و از اعمال زور غیرضروری یا نامتناسب پرهیز شود.
اظهارات و مواضع اخیر برخی نهادهای حقوق بشری فرانسه و بینالمللی نیز اهمیّت رعایت این اصول را مورد توجّه قرار داده است. کمیسیون ملّی مشورتی حقوق بشر فرانسه بر ضرورت رعایت آزادیهای بنیادین و رویکرد مبتنی بر گفتوگو و خویشتنداری در مواجهه با اعتراضات دانشآموزی تأکید کرده است. همچنین سازمان عفو بینالملل درباره نحوه واکنش پلیس فرانسه و ضرورت رعایت اصول قانونی بودن، ضرورت و تناسب در استفاده از زور ابراز نگرانی کرده است.
ستاد حقوق بشر جمهوری اسلامی ایران تأکید میکند که توجه به حقوق بشر نباید محدود به مرزهای جغرافیایی یا شرایط سیاسی خاص باشد. دولتهایی که در عرصه بینالمللی نسبت به وضعیت حقوق بشر در سایر کشورها اظهارنظر میکنند، طبیعتاً مسؤولیت بیشتری در رعایت و اجرای همان معیارها در داخل مرزهای خود دارند. این اصل، نه متوجّه فرانسه به عنوان یک کشور خاص، بلکه یک قاعده عمومی برای تمامی دولتهاست.

از همین منظر، مواضع دولت فرانسه در قبال تحوّلات ایران و بهویژه تجاوز نظامی آمریکا و رژیم صهیونیستی به جمهوری اسلامی ایران نیز نیازمند توجّه به اصل یکسانی معیارهاست.
جمهوری اسلامی ایران انتظار دارد همانگونه که دولت فرانسه بر حقوق مردم، حاکمیّت قانون و اصول حقوق بینالملل تأکید میکند، در قبال نقض حاکمیّت و تمامیّت ارضی کشورها نیز همین اصول را به صورت روشن، منسجم و فارغ از ملاحظات سیاسی مورد توجّه قرار دهد.
حقوق بشر و حقوق بینالملل، هنگامی میتوانند از اعتبار و کارآمدی لازم برخوردار باشند که اجرای آنها مبتنی بر معیارهای واحد و جهانشمول باشد. نمیتوان یک معیار را برای بررسی عملکرد دولتهای دیگر به کار گرفت و در شرایط مشابه، معیار متفاوتی را در مورد عملکرد خود یا متحدان به اجرا گذاشت. استمرار چنین رویکردی میتواند به تضعیف اعتماد عمومی به سازوکارهای بینالمللی حقوق بشر منجر شود.
ستاد حقوق بشر جمهوری اسلامی ایران ضمن تأکید بر اهمیّت حفظ نظم عمومی و امنیّت شهروندان در تمامی کشورها، از دولت فرانسه انتظار دارد نسبت به گزارشهای مربوط به جراحات شدید معترضان، بهویژه افراد کمسنوسال، و نحوه استفاده از ابزارهای کنترل جمعیت، تحقیقات مؤثر، مستقل و شفاّف انجام دهد و نتایج آن را در چارچوب قوانین و تعهدات بینالمللی خود منتشر کند.
همچنین انتظار میرود حقوق افراد بازداشتشده، بهویژه کودکان و نوجوانان، مطابق تعهدات بینالمللی فرانسه تضمین شود و هرگونه محدودیّت بر حق تجمع و آزادی بیان صرفاً در حدود مقرر در قانون و بر اساس اصول ضرورت و تناسب اعمال شود.
ستاد حقوق بشر جمهوری اسلامی ایران همچنین از نهادهای بینالمللی حقوق بشر انتظار دارد تحوّلات اخیر فرانسه را با همان معیارهای حقوقی و حقوق بشری که در بررسی وضعیت سایر کشورها مورد استفاده قرار میدهند، مورد توجّه قرار دهند. رعایت حقوق بشر یک تعهد مشترک و جهانشمول است و اجرای آن نباید تحت تأثیر ملاحظات سیاسی، ائتلافی یا ژئوپلیتیکی قرار گیرد.
جمهوری اسلامی ایران بر این باور است که تقویت گفتوگو، رعایت حق تجمع مسالمتآمیز، پاسخگویی نهادهای انتظامی و تضمین تحقیقات مستقل درباره ادعاهای نقض حقوق، بهترین مسیر برای حفظ اعتماد عمومی و صیانت از اصول حقوق بشر است.

The Statement by the High Council for Human Rights of the Islamic Republic of Iran on Recent Developments in France and the Need to Uphold Human Rights Standards
In light of recent developments in France and reports concerning the manner in which the country’s law enforcement and security forces have responded to assemblies and protests by students and young people, the High Council for Human Rights of the Islamic Republic of Iran emphasizes the necessity of fully respecting human rights standards and France’s international obligations.
These developments have taken place against the backdrop of positions adopted in recent months by certain European governments, including France, in response to the military aggression by the United States and the Zionist regime against Iranian territory. From the perspective of the Islamic Republic of Iran, these positions have fallen short of the clarity and firmness expected in the face of violations of the national sovereignty and territorial integrity of an independent state. Positions concerning the rights of nations and the rule of law can carry the requisite credibility and effectiveness only when these principles are upheld consistently in all circumstances, without regard to political or geographical considerations.
In recent days, numerous reports have been published concerning protests by students and young people in various cities across France. According to these reports, during police confrontations with some assemblies, a considerable number of people have been arrested, and a number of protesters, including minors, have sustained injuries. Cases of severe physical injuries have also been reported, and with regard to some of these incidents, official investigations are currently being conducted by the competent French authorities, including the General Inspectorate of the National Police of France.
Among the reported cases are the severe injury of a 14-year-old teenager in Saint-Ouen-l’Aumône, the loss of sight in one eye by a 16-year-old teenager in Tours, and the amputation of the hand of a 15-year-old teenager in Lens during incidents related to police operations. Given that investigations into the circumstances surrounding some of these incidents are still ongoing, any final determination regarding the legal responsibility of specific individuals or institutions requires the completion of the investigations and the conclusion of the relevant legal processes. Nevertheless, the severity of these injuries underscores the necessity of a thorough, independent, and transparent examination of these incidents.
From a human rights perspective, the right to freedom of peaceful assembly, the right to freedom of expression, the prohibition of arbitrary detention, the prohibition of cruel, inhuman or degrading treatment, and the principles of necessity and proportionality in the use of force are among the recognized principles of international law. While States have a responsibility to maintain public order and ensure the security of their citizens, they are required, when dealing with assemblies and protests, to strike a balance between law-enforcement requirements and the protection of individuals’ fundamental rights and freedoms.
Article 21 of the International Covenant on Civil and Political Rights recognizes the right to peaceful assembly. Article 7 of the same Covenant prohibits any cruel, inhuman or degrading treatment, and Article 9 emphasizes the protection of individuals against arbitrary arrest or detention. Furthermore, the Convention on the Rights of the Child, to which France is a party, recognizes the special protection afforded to children and adolescents and emphasizes the observance of the best interests of the child and treatment appropriate to their age and circumstances.
According to the United Nations Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, the use of force must likewise be governed by the principles of necessity and proportionality, and non-violent means should be used to the greatest extent possible. Therefore, even in circumstances where some participants in an assembly engage in violent conduct or disrupt public order, the response of law enforcement personnel should be directed at the specific unlawful conduct in question, and the use of unnecessary or disproportionate force should be avoided.
Recent statements and positions expressed by certain French and international human rights organizations have also drawn attention to the importance of observing these principles. The French National Consultative Commission on Human Rights has emphasized the need to respect fundamental freedoms and to adopt an approach based on dialogue and restraint when responding to student protests. Amnesty International has likewise expressed concern regarding the manner in which the French police have responded and the need to observe the principles of legality, necessity, and proportionality in the use of force.
The High Council for Human Rights of the Islamic Republic of Iran emphasizes that attention to human rights should not be limited by geographical boundaries or particular political circumstances. States that express views internationally regarding the human rights situation in other countries naturally bear a greater responsibility to respect and uphold those same standards within their own borders. This principle is not directed at France as a particular country; rather, it constitutes a general rule applicable to all States.
Accordingly, the position of the French Government regarding developments in Iran, and particularly the military aggression by the United States and the Zionist regime against the Islamic Republic of Iran, likewise requires due regard for the principle of consistent standards. The Islamic Republic of Iran expects that, just as the French Government emphasizes the rights of peoples, the rule of law, and the principles of international law, it should also clearly, consistently, and without political considerations uphold these same principles with regard to violations of the sovereignty and territorial integrity of States.
Human rights and international law can enjoy the necessary credibility and effectiveness only when their implementation is based on uniform and universal standards. One cannot apply one standard when assessing the conduct of other States and, under similar circumstances, apply a different standard to one’s own conduct or that of one’s allies. The continuation of such an approach may lead to a weakening of public confidence in international human rights mechanisms.
While emphasizing the importance of maintaining public order and the security of citizens in all countries, the High Council for Human Rights of the Islamic Republic of Iran expects the French Government to conduct effective, independent, and transparent investigations into reports concerning serious injuries sustained by protesters, particularly minors, as well as the manner in which crowd-control measures have been used, and to publish the findings within the framework of its laws and international obligations.
It is also expected that the rights of detained persons, particularly children and adolescents, be guaranteed in accordance with France’s international obligations, and that any restrictions on the right to assembly and freedom of expression be imposed solely within the limits prescribed by law and on the basis of the principles of necessity and proportionality.
The High Council for Human Rights of the Islamic Republic of Iran also expects international humanrights bodies to address recent developments in France according to the same legal and human rights standards that they apply when examining the situation in other countries.
Respect for human rights is a shared and universal obligation, and its implementation should not be influenced by political, alliance-based, or geopolitical considerations.
The Islamic Republic of Iran believes that strengthening dialogue, respecting the right to peaceful assembly, ensuring accountability of law enforcement authorities, and guaranteeing independent investigations into allegations of human rights violations constitute the best course for maintaining public confidence and safeguarding human rights principles.
