بیانیه ستاد حقوق بشر جمهوری اسلامی ایران در محکومیت حمله متجاوزانه به هواپیماهای غیرنظامی حامل کمک‌های بشردوستانه

ستاد حقوق بشر با انتشار بیانیه‌ای حمله به هواپیماهای غیرنظامی ایرانی حامل دارو و تجهیزات پزشکی را به‌شدت محکوم و این اقدام را نقض آشکار، جدی و غیرقابل توجیه از اصول بنیادین حقوق بین‌الملل، به‌ویژه حقوق بشردوستانه اعلام کرد.

متن این بیانیه به شرح زیر است:

بسم‌الله الرحمن الرحیم

ستاد حقوق بشر جمهوری اسلامی ایران حمله به هواپیماهای غیرنظامی ایرانی حامل دارو و تجهیزات پزشکی را به‌شدت محکوم می‌نماید و این اقدام را نقضی آشکار، جدی و غیرقابل توجیه از اصول بنیادین حقوق بین‌الملل، به‌ویژه حقوق بشردوستانه و مقررات بین‌المللی هوانوردی می‌داند.

هواپیماهای مورد هدف، در حال انجام ماموریتی کاملا بشردوستانه و با هدف انتقال دارو و تجهیزات پزشکی بوده‌اند؛ اقدامی که مستقیما با حق حیات، حق بر سلامت و دسترسی به خدمات درمانی گره خورده است؛ هرگونه تعرض به چنین ماموریت‌هایی، نه‌تنها جان انسان‌های بی‌گناه را به مخاطره می‌اندازد، بلکه اصول انسانی و اخلاقی مورد اجماع جامعه بین‌المللی را نیز نقض می‌نماید.

براساس کنوانسیون شیکاگو ۱۹۴۴ و کنوانسیون مونترال ۱۹۷۱، هرگونه اقدام علیه ایمنی هواپیماهای غیرنظامی، ازجمله حمله یا ایجاد اخلال در عملیات آن‌ها، از مصادیق جرایم بین‌المللی در حوزه هوانوردی محسوب می‌شود؛ همچنین مطابق قواعد حقوق بشردوستانه بین‌المللی، ازجمله مفاد پروتکل الحاقی اول به کنوانسیون‌های ژنو، حمله به اهداف غیرنظامی و به‌ویژه وسایل نقلیه حامل کمک‌های بشردوستانه، به‌عنوان نقض جدی حقوق بین‌الملل و در مواردی مصداق جنایت جنگی تلقی می‌گردد.

ستاد حقوق بشر جمهوری اسلامی ایران در این چارچوب، سازمان بین‌المللی هوانوردی غیرنظامی (ایکائو) را به‌عنوان نهاد تخصصی مسئول در حوزه ایمنی و امنیت هوانوردی بین‌المللی، مخاطب قرار داده و از آن سازمان انتظار دارد با اتخاذ موضعی قاطع، شفاف و مسئولانه، این اقدام خطرناک و غیرقانونی را محکوم نموده و اقدامات لازم را برای جلوگیری از تکرار چنین تهدیداتی علیه هواپیماهایی غیرنظامی به‌عمل آورد.

بدیهی است سکوت یا بی‌عملی در برابر چنین اقداماتی، می‌تواند امنیت و اعتماد عمومی به نظام هوانوردی بین‌المللی را به‌شدت تضعیف کرده و زمینه‌ساز گسترش ناامنی در عرصه حمل‌ونقل هوایی گردد.

ستاد حقوق بشر جمهوری اسلامی ایران ضمن تاکید بر مسئولیت عاملان این اقدام، اعلام می‌دارد پیگیری حقوقی این نقض آشکار از طریق سازوکارهای بین‌المللی ذی‌صلاح را در دستور کار خود قرار خواهد.

Statement of the High Council for Human Rights of the Islamic Republic of Iran Condemning the Aggressive Assault on the Civilian Aircrafts Carrying Humanitarian Aid

In the Name of God

The High Council for Human Rights of the Islamic Republic of Iran strongly condemns the attack on the civilian Iranian airplanes carrying medicines and medical equipment, and regards this act as a clear, serious, and unjustifiable violation of the fundamental principles of international law, especially humanitarian law and international aviation regulations.

The targeted aircrafts were on a completely humanitarian mission aimed at transporting medicines and medical equipment; an action tied directly to the right to life, the right to health, and access to medical services. Any assault on such missions not only endangers the lives of innocent people but also violates the ethical and humane principles that enjoy international consensus.

According to the Chicago Convention of 1944 and the Montréal Convention of 1971, any act against the safety of civil aircrafts, including attacks or interference with their operations, constitutes international crimes in the field of aviation. Moreover, under international humanitarian rights law, including the provisions of Additional Protocol I to the Geneva Conventions, attacking civilian targets and, in particular, vehicles carrying humanitarian aid, is considered a serious violation of international law and, in some cases, a war crime.  

Within this framework, the High Council for Human Rights of the Islamic Republic of Iran addresses the International Civil Aviation Organization (ICAO) as the specialized body responsible for international aviation safety and security, and expects it to adopt a firm, transparent, and responsible stance to condemn this dangerous and illegal act and take the necessary measures to prevent a repetition of such threats against civilian aviation.

Obviously, silence or inaction in response to such actions can severely undermine the security and public trust in the international aviation system and pave the way for greater insecurity in the field of air transport.

The High Council for Human Rights of the Islamic Republic of Iran, while reaffirming accountability for the perpetrators of this act, states that pursuing legal remedies for this clear violation through the appropriate international mechanisms is on its agenda.
