بیانیه ستاد حقوق بشر در اعتراض به حملات رژیم صهیونیستی و آمریکا به مراکز درمانی و امدادرسانی

ستاد حقوق بشر با انتشار بیانیه‌ای، حملات صورت‌گرفته به مراکز درمانی، امدادرسانی، هلال احمر، رسانه‌ای، مدارس و اماکن مسکونی کشور را در جریان تجاوز وحشیانه رژیم صهیونیستی  و آمریکا به‌شدت محکوم کرد و این اقدامات را نقض فاحش، گسترده و نظام‌مند حقوق بین‌الملل، حقوق بشردوستانه و تعهدات و موازین  بنیادین حقوق بشری توصیف کرد.

متن این بیانیه به شرح زیر است:

«حملات صورت‌گرفته علیه مراکز درمانی و امدادرسانی در شهر‌های همدان، سراب و چابهار که منجر به هدف قرار گرفتن سه پایگاه اورژانس شد، همچنین حمله در مجاورت بیمارستان شهید مطهری و تخلیه اضطراری بیماران، تعرض به بیمارستان خاتم‌الانبیاء، حمله به بیمارستان گاندی تهران، هدف قرار دادن یک مرکز درمانی در اهواز، حمله به مراکز هلال احمر، حمله به مناطق مسکونی از جمله در سنندج و تخریب دو ساختمان نقض فاحش، گسترده و نظام‌مند حقوق بین‌الملل، حقوق بشردوستانه و تعهدات و موازین  بنیادین حقوق بشری محسوب می‌شوند.

بر اساس اطلاعات موجود، در جریان  تجاوز وحشیانه رژیم صهیونیستی و امریکا به ایران تاکنون ۵۵۵ شهروند بی‌گناه از جمله زنان و کودکان معصوم به شهادت رسیده‌اند. این آمار، بیانگر گستردگی خسارات انسانی و ضرورت توجه فوری جامعه بین‌المللی به نقض‌های جدی حقوق بشری رخ‌داده است. حق حیات به‌عنوان بنیادی‌ترین حق بشری، در اسناد جهانی از جمله میثاق‌های بین‌المللی حقوق بشر مورد شناسایی قرار گرفته و سلب خودسرانه آن تحت هیچ شرایطی قابل توجیه نیست.

مطابق کنوانسیون‌های چهارگانه ژنو ۱۹۴۹ و پروتکل‌های الحاقی، مراکز درمانی، بیمارستان‌ها، پایگاه‌های اورژانس و کارکنان کادر پزشکی در هر شرایطی باید مورد احترام و حمایت قرار گیرند. هدف قرار دادن عامدانه این مراکز، نقض صریح اصل تفکیک میان اهداف نظامی و غیرنظامی است. حمله به زیرساخت‌های درمانی و مناطق مسکونی، با توجه به آثار گسترده آن بر جان و سلامت غیرنظامیان، فاقد هرگونه توجیه حقوقی است.

علاوه بر این، حمله به زیرساخت‌های رسانه‌ای و تلاش برای خاموش‌سازی جریان اطلاع‌رسانی، تعرض مستقیم به آزادی بیان و حق دسترسی مردم به اطلاعات محسوب می‌شود؛ حقی که در اسناد بین‌المللی حقوق بشر تضمین شده و از ارکان اساسی یک جامعه مبتنی بر کرامت انسانی و حاکمیت قانون به‌شمار می‌رود.

ادعا‌های مطرح‌شده از سوی متجاوزان و حامیان آنان مبنی بر پایبندی به حقوق بشر و رعایت اصول بشردوستانه، در پرتو این حملات، با چالش جدی مواجه است. هدف قرار دادن بیمارستان‌ها، مراکز امدادی و مناطق مسکونی، تعارض آشکار میان گفتار و رفتار را نمایان ساخته و نشان می‌دهد که استاندارد‌های دوگانه و رویکرد‌های گزینشی، جایگزین اجرای بی‌طرفانه قواعد بین‌المللی شده است.

ستاد حقوق بشر جمهوری اسلامی ایران طبق این بیانیه، کمیسیرعالی حقوق بشر، شورای حقوق بشر سازمان ملل متحد و سایر سازوکار‌های حقوق بشری را مخاطب قرار می‌دهد و تأکید می‌کند که سکوت و واکنش‌های منفعلانه برخی کشور‌های مدعی دفاع از حقوق بشر در برابر این نقض‌های آشکار، با تعهدات بین‌المللی آنان ناسازگار بوده و موجب تضعیف اعتبار نظام جهانی حمایت از حقوق بشر می‌شود.

پر واضح است که حمله به بیماران، امدادگران، خبرنگاران و شهروندان بی‌دفاع، تعرضی مستقیم به کرامت انسانی و اصول بنیادین حقوقی جامعه بین‌المللی است و استمرار این روند، مسئولیت بین‌المللی عاملان و حامیان آن را به دنبال خواهد داشت.

*Statement by the High Council for Human Rights of the Islamic Republic of Iran Condemning the Barbaric Attacks by the Zionist Regime and the United States Against Medical, Relief, Red Crescent, Media, Educational, and Residential Centers*   

The High Council for Human Rights of the Islamic Republic of Iran hereby issues a statement to denounce the attacks against medical and relief centers, Red Crescent facilities, media outlets, educational institutions, and residential buildings throughout the country during the brutal aggression launched by the Zionist regime and the United States, categorizing these actions as constituting grave, widespread, and systematic violations of international law, international humanitarian law, and fundamental human rights obligations and principles.

The full text of the statement is as follows:

The attacks conducted against medical and relief establishments in the cities of Hamedan, Sarab, and Chabahar, targeting three emergency bases, along with the attack near Shahid Motahari Hospital resulting in the emergency evacuation of patients, the strike on Khatam al-Anbiya Hospital, the assault on Gandhi Hospital in Tehran, the targeting of a medical center in Ahvaz, attacks on Red Crescent facilities, and offensives against residential areas, notably in Sanandaj resulting in the demolition of two buildings, constitute flagrant, extensive, and systematic breaches of international law, international humanitarian law, and fundamental human rights standards.

In light of available data, in the course of the brutal aggression by the Zionist regime and the United States against the Islamic Republic of Iran, 555 innocent civilians, including innocent women and children, have been martyred to date. This statistic underscores the magnitude of the human cost and the imperative for the urgent attention of the international community regarding the grave human rights violations that have unfolded. The right to life, enshrined as the most fundamental human right in global instruments, including the International Covenants on Human Rights, and its arbitrary deprivation, is unjustifiable under any circumstances.

In accordance with the Four Geneva Conventions of 1949 and their Additional Protocols, medical facilities, hospitals, emergency bases, and medical personnel are entitled to respect and protection under all circumstances. The deliberate targeting of these centers constitutes a grave violation of the principle of distinction between military targets and civilian objects. The attacks on medical infrastructure and residential zones, given their profound and extensive impact on the lives and well-being of civilians, are devoid of any legal justification.

Furthermore, attacks against media infrastructure and measures aimed at suppressing the flow of information constitute a grave breach of freedom of expression and the public’s right to access information; a right guaranteed under international human rights instruments and regarded as a pillar of a society founded upon human dignity and the rule of law.

The claims made by the aggressors and their supporters regarding adherence to human rights and humanitarian principles are severely compromised in light of these attacks. The targeting of hospitals, relief centers, and residential areas exposes a manifest contradiction between discourse and conduct, demonstrating that double standards and selective approaches have superseded the impartial implementation of international norms.

Through this statement, the High Council for Human Rights of the Islamic Republic of Iran addresses the United Nations High Commissioner for Human Rights, the UN Human Rights Council, and other international human rights mechanisms, emphasizing that the silence and passive reactions of certain states claiming to defend human rights in the face of these grave violations are incongruent with their international obligations and result in undermining of the credibility of the international human rights system.

It is unequivocally clear that assaults against patients, relief workers, journalists, and defenseless civilians represent a direct affront to human dignity and the foundational legal principles of the international community, and the continuation of this course shall invoke international responsibility for the perpetrators and their supporters.
