Pathology of the Expert Category in Judicial Cases by the Chief of the Judiciary

During this visit, the Head of the Judiciary and other high judicial officials will hold programs aimed at resolving legal and judicial issues and problems of the people of Lorestan Province.
In a speech to the judges and judicial staff of Lorestan Province, Mohseni Ejei stated: Imam Khomeini (RA) brought about the greatest revolution with his great capital, namely his firm faith in the divine promise. Now we have a duty to complete the remarkable achievements of the Islamic Revolution; among these important achievements are independence and freedom.
The Chief of the Judiciary said: People rightly have expectations from the Judiciary; We must do our utmost to use our legal position to resolve people's problems; people do not have high expectations from us; people expect us to deal with their grievances openly and honestly when they complain to us. People expect us to act quickly in handling their legal cases.
Mohseni Ejei stated: Sometimes the reason for the delay in handling some judicial cases is due to problems that arise from experts. Accordingly, our judges should be careful that expertise in judicial cases is a matter of procedure, not substance; therefore, when there is no need to refer to an expert in a case, this should be avoided. Also, when referring a case to an expert, our judicial colleagues should clearly and transparently request the expert opinion from the expert authority and not in such a way that the expert authority provides ambiguous answers.
The head of the judiciary stated: When referring a case to an expert authority, the judicial authority should pay attention to the fact that that authority is experienced and specialized in that field; and it should also be important that that expert authority does not simultaneously assume the responsibility of expert opinion on several cases, because in this case, we will encounter delays and hesitation in providing an opinion. Another important point is that when referring a case to an expert authority, the judicial authority should set a specific time for this authority to return the case and provide an opinion.
The Chief Justice stated: "Our judges should be extremely careful in issuing criminal bail orders. We have repeatedly emphasized that in cases where it is not necessary, do not issue an arrest warrant for a defendant and do not set bail in such a way that the person goes to jail even for one night; sometimes even spending one night in jail turns a person's life upside down."
